SubHome — Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of SubHome ("SubHome", "we", "us", "our"), a subscription management and savings optimisation application operated as an Einzelfirma under Swiss law.
By accessing or using SubHome, you agree to these Terms. If you do not agree, you may not use the service.
2. Service Description
SubHome provides tools to:
- Track subscriptions and recurring expenses
- Receive renewal reminders
- Analyse spending
- Generate AI-assisted cancellation, negotiation, and optimisation suggestions
- Send communications to third-party providers on your behalf (with your explicit per-action authorisation)
- Manage subscriptions individually or within a household
SubHome is provided as a software-as-a-service (SaaS) application, accessible via web (subhome.app), iOS, and Android.
3. Eligibility
You must:
- Be at least 16 years old (users under 18 require parental or guardian consent)
- Have the legal capacity to enter into binding agreements, or have authorisation from a parent or legal guardian
4. Account Registration
You are responsible for:
- Maintaining the confidentiality of your account credentials
- Providing accurate and up-to-date information
- All activity under your account
You agree not to:
- Use the service for unlawful purposes
- Attempt to reverse-engineer, decompile, or exploit the system
- Use automated tools to scrape, copy, or replicate SubHome's features or data
- Abuse AI features or automated systems
- Share your account credentials with third parties
5. Pricing and Subscription
5.1 Plans
SubHome offers:
- Free Plan: Limited features (see Section 6)
- SubHome Pro Subscription:
- CHF 3.90 per month (billed monthly)
- CHF 29.90 per year (billed annually, discounted)
Prices may vary by region and applicable taxes. Prices displayed at checkout are inclusive of any taxes collected by our payment provider.
5.2 Merchant of Record
Payments are processed by Paddle.com Market Ltd ("Paddle"), which acts as the Merchant of Record for all SubHome purchases.
This means:
- Paddle is the legal seller of the service
- Paddle handles billing, invoicing, VAT/sales tax collection, and remittance
- Your purchase is subject to Paddle's Buyer Terms
- All payment disputes, chargebacks, and billing inquiries are handled by Paddle
By completing a purchase, you agree to Paddle's Buyer Terms in addition to these Terms.
5.3 In-App Purchases
If you purchase SubHome Pro through the Apple App Store or Google Play Store, the terms and conditions of the respective platform also apply. Payment processing, billing, and refunds for in-app purchases are handled by Apple or Google in accordance with their policies.
5.4 Billing and Renewal
Subscriptions:
- Are billed in advance at the start of each billing period
- Renew automatically at the end of each billing period
- Continue until cancelled
You may cancel at any time through your account settings, Paddle's customer portal, or the respective app store. Cancellation takes effect at the end of the current billing period. You retain access to paid features until the end of your paid term.
5.5 Refunds
Refunds are handled in accordance with Paddle's refund policies (for web purchases) or the applicable app store's refund policies (for in-app purchases).
EU/EEA customers may have a statutory 14-day right of withdrawal for digital goods. This right is handled in accordance with Paddle's policies and applicable local law.
Unless otherwise required by law, payments are non-refundable after the applicable withdrawal period.
5.6 Price Changes
We may update pricing from time to time. We will notify you at least 30 days before any price increase takes effect. You may cancel your subscription before the new price applies. If you do not cancel, the new price will apply at the next billing cycle after the notice period.
6. Free Plan Limitations
The free plan includes limitations such as:
- Maximum of 10 tracked subscriptions
- Up to 2 household members
- No access to AI-powered features (cancellation coach, negotiation, insights)
- No access to price increase alerts
We reserve the right to modify free plan features and limits. Existing free plan users will be notified of material changes.
7. AI Features and Usage
SubHome provides AI-powered features including:
- Interactive cancellation guidance
- Bill negotiation strategies and email drafting
- Savings recommendations and alternative suggestions
- Subscription parsing and categorisation
7.1 Third-Party AI Processing
AI features are powered by third-party providers (Anthropic). When you use AI features:
- Your subscription data (names, costs, billing periods) may be sent to the AI provider for processing
- No personally identifiable information (name, email, address) is shared with AI providers unless explicitly required for a feature (e.g., including your name in a negotiation email you have approved)
- Data processing is governed by our Privacy Policy
7.2 No Professional Advice
AI-generated content:
- Is for informational purposes only
- Does not constitute legal, financial, tax, or professional advice
- May contain inaccuracies or outdated information
You are solely responsible for verifying information and for any decisions or actions taken based on AI outputs.
7.3 No Guarantees
We do not guarantee:
- Successful cancellations
- Successful negotiations or bill reductions
- Any specific level of savings
- Accuracy or completeness of AI-generated content
Actual results vary by provider, contract terms, jurisdiction, and user actions.
7.4 Emails and Communications Sent on Your Behalf
SubHome may offer features that draft and send emails to third-party service providers on your behalf (e.g., cancellation requests, negotiation letters). When using these features:
- Each email requires your explicit, per-message authorisation before sending
- You review and may edit the content before it is sent
- Emails are sent from a SubHome domain with your name and a reply-to address directing responses to you
- You are solely responsible for the content and consequences of any communication initiated through SubHome
- SubHome is not a party to any agreement between you and the third-party provider
7.5 Usage Limits
AI features may be subject to:
- Monthly or hourly usage limits
- Fair use restrictions
- Rate limiting to ensure service quality for all users
We may restrict or suspend access to AI features to prevent abuse or excessive usage. Current limits are documented in the application.
8. Savings Claims
Statements such as "SubHome pays for itself" or estimated savings figures are illustrative. They:
- Reflect typical or estimated outcomes based on aggregated user data
- Do not guarantee individual results
- Should not be relied upon as financial projections
9. User Responsibilities
You are responsible for:
- Verifying all information before acting on it
- Ensuring compliance with your existing contractual obligations to third-party providers
- Managing communications and relationships with third-party providers
- Obtaining any necessary permissions before adding other people's data to your account
SubHome only acts on your behalf when you provide explicit, per-action authorisation (such as approving an email before it is sent).
10. Household / Family Features
If you use shared household features:
- The account owner is responsible for managing access and invitations
- Shared data (subscriptions, spending) is visible to all household members
- You must obtain consent from all household members before adding them
- Each household member must meet the eligibility requirements in Section 3
- The account owner is responsible for ensuring parental consent is obtained for members under 18
11. Intellectual Property
All content, software, designs, trademarks, and features of SubHome are owned by SubHome or its licensors and protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the service for its intended personal or household purpose.
You may not:
- Copy, distribute, sublicense, or resell the service or its content
- Reverse-engineer, decompile, or disassemble the software
- Remove or alter any proprietary notices or marks
- Use SubHome's name, logo, or branding without written permission
12. Data and Privacy
Your use of SubHome is subject to our Privacy Policy.
We process data in accordance with:
- The Swiss Federal Act on Data Protection (revDSG)
- The EU General Data Protection Regulation (GDPR), where applicable to users in the EU/EEA
- Applicable international data protection regulations
You may request access to, correction of, or deletion of your personal data at any time as described in our Privacy Policy.
13. Communications
By creating an account, you consent to receiving:
- Service-related communications (renewal reminders, security alerts, account notifications)
- Product updates related to features you use
Marketing communications require separate opt-in consent and can be unsubscribed from at any time via the link in each email or through your account settings.
14. Beta Features
SubHome may offer beta or experimental features. These are:
- Clearly marked as "Beta" or "Experimental"
- Provided without warranty of any kind
- Subject to modification, limitation, or removal without notice
- Not guaranteed to be included in future versions of the service
15. Service Availability
We aim to provide a reliable service but do not guarantee:
- Uninterrupted availability
- Error-free operation
- Compatibility with all devices or operating systems
We may:
- Modify, update, or discontinue features with reasonable notice
- Perform scheduled and emergency maintenance
- Limit functionality during periods of high demand
16. Termination
16.1 Termination by You
You may terminate your account at any time through your account settings. Upon termination:
- Access to paid features ends at the conclusion of your current billing period
- Your data will be retained for 30 days to allow reactivation
- After 30 days, your data will be permanently deleted
- Data required for legal compliance (e.g., invoicing records) may be retained for up to 10 years as required by Swiss law (OR Art. 958f)
16.2 Termination by SubHome
We may suspend or terminate your access if:
- You violate these Terms
- You misuse the service or AI features
- Your account shows no activity for more than 24 months
- Required by law or regulatory order
Where possible, we will provide notice before termination and an opportunity to export your data.
17. Limitation of Liability
To the maximum extent permitted by applicable law:
- SubHome is provided "as is" and "as available"
- We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement
We are not liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, savings, data, or business opportunities
- Failed cancellations or negotiations with third-party providers
- Decisions or actions taken based on AI outputs
- Actions or omissions of third-party service providers
- Service interruptions or data loss
Our total aggregate liability for any claims arising from or related to these Terms or your use of SubHome is limited to the amount paid by you to SubHome in the 12 months preceding the claim, or CHF 100, whichever is greater.
Nothing in these Terms excludes or limits liability for fraud, gross negligence, wilful misconduct, or death or personal injury caused by our negligence, to the extent such exclusion is prohibited by applicable law.
18. Indemnification
You agree to indemnify, defend, and hold SubHome harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the service
- Your violation of these Terms
- Your interactions with third-party providers
- Communications sent through SubHome on your behalf
- Content you provide or share through the service
19. Dispute Resolution
Before initiating legal proceedings, both parties agree to attempt to resolve any dispute through direct communication within 30 days of the dispute arising. Notices should be sent to the contact address in Section 22.
If the dispute cannot be resolved amicably, it shall be submitted to the competent courts as set out in Section 20.
20. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the substantive laws of Switzerland, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-laws provisions.
The place of jurisdiction is Zürich, Switzerland.
For consumers domiciled in Switzerland, the mandatory forums under Swiss law (ZPO Art. 32) remain reserved. For consumers domiciled in the EU/EEA, mandatory consumer protection provisions of their country of residence apply to the extent required by applicable law.
21. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes at least 14 days in advance via email or in-app notification.
If you do not agree with the revised Terms, you may terminate your account before the changes take effect. Continued use of the service after the effective date of changes constitutes acceptance of the revised Terms.

23. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a competent court, the remaining provisions remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.
24. Entire Agreement
These Terms, together with the Privacy Policy and any applicable Paddle Buyer Terms or app store terms, constitute the entire agreement between you and SubHome regarding use of the service and supersede all prior agreements or understandings.
No failure or delay by SubHome to exercise any right or remedy shall constitute a waiver of that right or remedy.
